CardWorld — Terms of Service

CardWorld is operated by CardWorld (UEN [UEN to be provided]), of [address to be provided], Singapore ("CardWorld", "we", "us"). These Terms are a binding agreement between you and CardWorld covering the website at cardworld.io and everything you do on it. Ticking the box when you create an account is your electronic signature accepting them (Electronic Transactions Act 2010). If you do not accept them, do not use the site.

1. What CardWorld is, and whose agent it is
CardWorld is a marketplace for trading-card collectibles — graded slabs, raw cards and sealed product. Items are sold in two ways:
- Auctions. Sellers consign cards to CardWorld. We verify and photograph each card and sell it at auction from S$1 with no reserve. CardWorld holds the card throughout, ships it to the winner and pays the seller.
- Marketplace. Sellers list items at a fixed price (buyers may also make offers). When an item sells, the seller ships it to CardWorld, we inspect it, and only then do we ship it to the buyer and release the seller's money.
In every sale, CardWorld acts as the seller's agent: the seller authorises us to sell the item on their behalf, to hold it, to receive the buyer's payment for them, and to pay them the proceeds. The contract of sale is between the buyer and the seller. Paying CardWorld settles your debt to the seller in full; the seller looks only to CardWorld for the proceeds.
2. Accounts
- You must be at least 18 years old.
- One account per person, one account per email address. Your display name must be unique and must not impersonate anyone or be offensive.
- Keep your password private. Every sign-in requires a code sent to your email; anything done from your account after that code is treated as done by you. Tell us at once if you believe your account has been used without your permission.
- We may suspend or close an account that breaks these Terms, is used for fraud, or where the law requires it. You may close your account at any time; obligations already incurred (payments due, items sold, items consigned) survive closure.
3. Bidding at auction
- Every bid is binding. Placing a bid is an offer to buy the lot at up to the amount you enter, plus the shipping charge itemised before you bid.
- Maximum bids. You bid a maximum. CardWorld bids on your behalf only as much as needed to keep you ahead, in the published increments. Your maximum is never shown to other bidders while you lead.
- Bidder identities are shown as aliases ("Bidder 3"). Do not attempt to identify or contact other bidders.
- Soft close. A bid that changes the price or the leader within the final 2 minutes extends the auction by 2 minutes, up to a maximum of 3 hours of extensions.
- No reserve. Every lot starts at S$1 and sells to the highest bidder when time runs out.
- Bids cannot be withdrawn. If you win, you must pay the winning amount plus shipping within 72 hours of the auction ending.
- Non-payment. If you do not pay in time, the sale is cancelled. We may block you from bidding, suspend your account and recover any costs caused.
- Shill bidding — bidding on your own lot, or arranging for someone to bid on it for you — is prohibited and grounds for permanent closure of every account involved.
4. Buying on the marketplace
- A fixed-price purchase or an accepted offer is a binding sale. The item is held for you for 15 minutes at checkout; if payment is not completed it goes back on sale.
- Offers must be at least 30% of the asking price; each side has 48 hours to reply, with up to 3 counter-offers each. A purchase or an accepted offer must be paid within 24 hours.
- Inspection before delivery. The seller ships the item to CardWorld, which must receive it within 14 days of your payment. We check that it matches its listing. If it passes, we ship it to you. If it fails, or never arrives, you are refunded in full and the sale is cancelled.
- There is no general right under Singapore law to cancel an online purchase once made; the refund rules in these Terms and your statutory rights (section 12) apply.
5. Prices, fees and payment
- All prices are in Singapore dollars (SGD). Other currencies shown on the site are approximate conversions for convenience only; the SGD amount at checkout is what you pay.
- Buyer charges. No buyer's premium. A buyer pays the item price plus a shipping and protection charge: S$8 per shipment plus 1% of the item value (minimum S$2), all itemised before you commit. The protection part covers loss or damage in transit as described in section 6; it is a service charge, not an insurance policy.
- GST. CardWorld is not currently registered for GST, so no GST is charged. If we become registered, GST will be shown at checkout before you pay.
- Seller charges. No commission on the sale price. The seller receives the item price. The shipping and protection charge paid by the buyer is retained by CardWorld.
- Payment is by card through our payment provider, Stripe. We never see or store your full card number.
- Fee schedules and timings may be changed for future sales; the figures in force are always shown before you bid or buy.
6. Shipping, delivery and loss in transit
- CardWorld ships every item from Singapore, tracked, within 2 business days of payment (auction lots and vault items) or of a passed inspection (marketplace items).
- Loss or damage in transit. If an item we shipped to you is lost or arrives damaged, CardWorld will replace it where possible or refund what you paid for it, provided you tell us within 7 days of the delivery date shown by the courier (or of the expected delivery date, if it never arrives), with photographs of the item and packaging where relevant. Keep the packaging until we have replied.
- You are responsible for giving a correct delivery address and for any import duties, taxes or customs charges of your country.
7. Selling: consignment for auction
- By consigning a card you confirm that you own it outright, that it is authentic, and that it is not stolen, counterfeit, tampered with or subject to any claim.
- Ship it to CardWorld tracked and insured, marked with the reference we give you. Until we receive it, it is at your risk.
- We verify the certificate and condition and photograph the card. We may decline any card at our discretion. A card that fails verification is returned to you on payment of a return fee of S$12 (covering return shipping); items that appear counterfeit or stolen may be reported where the law requires.
- Accepted cards are listed at auction from S$1 with no reserve and cannot be withdrawn once the auction has started. Unsold cards stay in your Collection: you may list them on the marketplace, consign them again, or ask for them back (return fee applies).
- When a card sells and the buyer pays, the price is credited to your CardWorld balance immediately, because we already hold the card.
8. Selling: marketplace listings
- The same ownership and authenticity promises apply. Your listing must describe the item accurately, with your own photographs of the actual item.
- When your item sells, ship it to CardWorld within 3 business days, tracked and insured, so that it arrives within 14 days of the buyer's payment. If it does not arrive in time the sale is cancelled and the buyer refunded.
- Your proceeds are held as pending until the item passes our inspection, then become available in your balance. If the item fails inspection, the sale is cancelled, the buyer is refunded, and the item is returned to you on payment of the return fee.
- Repeated failed inspections, mismatched items or cancellations may result in suspension.
9. Your balance and withdrawals
- Your CardWorld balance shows money CardWorld holds for you as your agent: the proceeds of your sales and any refunds due to you. It is held in SGD.
- You may withdraw it at any time to a Singapore bank account or PayNow account in your own name. Withdrawals are made manually by our staff, normally within 3 business days.
- For security, a withdrawal may be held for 48 hours after a password reset, an email change, or the addition of a new bank or PayNow account, and larger withdrawals may require a check of your identity before payment.
- The balance is not a bank deposit, earns no interest and is not covered by any deposit insurance. Money you owe us or a buyer (for example a return fee, or a refund after a failed inspection) may be deducted from it.
10. Prohibited items and conduct
You may not list, consign, sell or bid on:
- counterfeit, proxy, replica, altered or trimmed cards, or slabs with tampered cases or labels;
- stolen goods or items you do not have the right to sell;
- anything whose sale would break a law or infringe a third party's rights.
You may not use the site with bots or scripts, scrape it, interfere with its operation, attempt to access other accounts or data, place bids or offers you do not intend to honour, manipulate prices, or harass other members or our staff.
11. Problems with an order and disputes between members
Tell us about any problem with an order within 7 days of delivery through your account or at hello@cardworld.io. We will investigate, may ask both sides for evidence, and will decide the outcome — including refunds — in good faith based on our inspection records and photographs. Our decision settles the matter between the buyer and the seller as far as CardWorld's handling is concerned; it does not take away either side's legal rights.
Refunds are made to the payment method used for the purchase; a card refund usually appears within 5–10 business days of being issued.
12. Your statutory rights
Nothing in these Terms reduces rights you have by law that cannot be excluded. In particular, where you buy as a consumer from a seller acting in the course of a business, or from CardWorld itself, you keep your rights under the Consumer Protection (Fair Trading) Act 2003, including the "Lemon Law" remedies for goods that do not conform to the contract, and the implied terms of the Sale of Goods Act 1979. Sellers on the marketplace may be private individuals, to whom some of those rights do not apply. If you live outside Singapore, the consumer laws of your country may give you additional rights.
13. Content and intellectual property
The CardWorld name, site design, the photographs we take and our text are ours or licensed to us. Photographs you upload remain yours, but you grant us a worldwide, royalty-free licence to use them to run the site (listings, records, promotion of your listing). Pokémon and other trading-card names and images are trademarks of their owners; CardWorld is not affiliated with or endorsed by them.
14. Availability and liability
- We aim to keep the site available at all times but do not guarantee it. An auction may be paused, extended or cancelled if a technical fault, fraud, or a legal requirement affects it; we will say so on the lot page and by email.
- Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, for fraud, or for anything that cannot be limited under the Unfair Contract Terms Act 1977 or any other law.
- Otherwise, our total liability to you for any claim relating to an item is limited to the price paid for that item plus the charges you paid us for it, and we are not liable for indirect or consequential loss, loss of profit or loss of opportunity.
- We are not liable for delay or failure caused by events outside our reasonable control (courier failure, postal disruption, outages of our service providers, natural disaster, government action), though we will do what we reasonably can to reduce their effect.
15. Changes to these Terms
We may update these Terms. Changes that matter to you will be announced on the site and by email at least 14 days before they take effect, and you will be asked to accept the new version the next time you sign in. Bids, purchases and consignments already in progress stay on the Terms in force when they were made.
16. Law and disputes with CardWorld
These Terms are governed by the laws of Singapore. If a dispute between you and CardWorld cannot be resolved together within 30 days, the courts of Singapore have exclusive jurisdiction. Consumers may also bring eligible claims to the Small Claims Tribunals of Singapore. If any part of these Terms is found unenforceable, the rest continues to apply. You may not transfer your agreement with us to anyone else.
